· All NYS contracts are reported on the NYS website Open Book New York : Open Book New York – Office of the State Comptroller for public viewing.
o Buffalo State University uses the reporting available in the New York State Contract System as an agency only reporting tool.
Description of the methodology used to assess the institution’s contract spend with social impact suppliers:
The methodology used to collect the campus contract spend is that required to be used by the SUNY wide office of MWBE. The reporting tool within provides a report of MWBE utilization by SUNY campuses, and allows the campus to set the parameters and criteria of the report to include, timeframe (start and end date), payment type (PO’s contracts, Pcards) Campus location. This information is verified and validated on a quarterly basis by the SUNY office of MWBE for final reporting available here.

· Does the institution have a published code of conduct to guide suppliers on the institution’s social and environmental expectations for them? (required). Expectations may include, for example, a general commitment to help the institution advance its sustainability goals and/or compliance with existing social and environmental regulatory requirements or policies.
o SUNY Buffalo State has implemented NYS Executive order 22-Green Purchasing into our routine Procurement practices. In doing so, we require the purchase of commodities, services, and technology that meet the approved green procurement specifications listed. o Buffalo State provides potential suppliers the document ‘How to Do Business with US’ which provides a summary of our specific mission and values at Buffalo State, along with our regulatory requirements. (Attached) It is published here: SUNY Buffalo State-How to Do Business With Us.pdf
o Suppliers are also provided the document ‘Doing Business with New York State’ which provides information and resources to suppliers on procurement priorities and processes which cover a wide variety of topics inclusive of social and environmental expectations. · Does the institutions supplier code of conduct include one or more expectations in regard to environmental impact that exceed or are additional to regulatory compliance?
o Yes; for example we require our campus-wide janitorial cleaning supplies to be fully ‘green’ as outlined in Executive Order 22
· Treatment of Workers:
o Suppliers whom contract with Buffalo State are required to sign and adhere to NYS Executive Order No. 177: prohibiting discrimination and harassment based on age, race, creed, color, national origin, sex, etc. related t their employees, labor organizations and training programs.
· Governance and ethical business practices :
o Buffalo State requires vendors complete a Vendor Responsibility Questionnaire before issuance of a contract, which covers anti-corruption, fair business practices, etc. ( Attached)
o Additionally, we use resources from over a dozen sources as part of our standard process that are above and beyond this questionnaire to assist in our determination of responsibility-attached.
· Advancement of sustainability in the supply chain:
o We require all suppliers who reply to a formal bid to complete a Diversity Practices Questionnaire which included questions regarding gross revenues paid to certified MWBE’s in NYS, if they provide technical training to MBWE’s, and if their proposed sub-contractors require the use of a MWBE utilization plan.
· Monitoring and Review:
o Buffalo State performs annual spend reporting related to MWBE utilization, as well as annual reporting related to green purchasing and related expenditures and compliance.
