GENERAL CONDITIONS Governing Law The laws of the Province of Ontario shall govern this agreement. Comply With Laws The successful bidder shall comply with all applicable statutes, laws, by-laws, regulations, ordinances, notices and orders whether Federal, Provincial, Municipal or otherwise, at any time in effect during the currency of this contract, and all rules and requirements of the Police and Fire departments, or other governmental authorities, and procure all C.S.A. approvals, if required. The successful bidder shall obtain and pay for all necessary permits and licenses, and shall not do or suffer to be done anything in violation of any such laws, ordinances, rules or requirements. If the attention of the successful bidder is called to any such violation on the part of the successful bidder, or of any person employed or engaged by the successful bidder, the successful bidder shall immediately desist from and correct such violation. AODA Laws & Regulations The Vendor shall comply with all relevant Federal, Provincial and Municipal Statutes, Regulations and By-laws, and the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), pertaining to the Work. In addition, pursuant to Ontario Regulation 429/07, Accessibility Standards for Customer Service, as provided for under the Accessibility for Ontarians with Disabilities Act (AODA), every person who deals with members of the public on behalf of the College and/or who participates in the development of policies, practices or procedures, must receive training with respect to the provision of service to persons with disabilities. Ethical Conduct It is expected that suppliers for Mohawk College will adopt, both for themselves and their employees, the highest ethical standards in the industry. All suppliers should become familiar with applicable Provincial and Federal standards and/or statutes concerning ethical conduct in a business setting. W.H.M.I.S. The successful bidder shall be required to submit Material Safety Data Sheets or Information Sheets on all W.H.M.I.S. regulated or "controlled substance" materials to be ordered. This information is required in order to comply with the W.H.M.I.S. legislation. It is the duty of the bidder to ensure that all material safety data sheets are current, contain all the required information under the W.H.M.I.S. legislation (Occupational Health & Safety Act of Ontario, as amended) and that they are dated and signed for future review. Health & Safety Manual The successful bidder shall submit to the Project Manger their corporate Health & Safety Manual, before commencing any work. Occupational Health & Safety The bidder warrants that the items supplied to the College conform in all respects to the standards set forth by Federal and Provincial agencies and failure to comply with this condition will be considered a breach of contract. The Occupational Health and Safety Act, and Regulations thereunder, as may be amended from time to time, shall govern the operation of these projects. Responsibility for compliance with the Act and Regulations rests exclusively with the contractor and may be subject to the scrutiny of Mohawk College authorities. Regulations are available from the Ministry of Labour offices. CONSTRUCTION PROJECTS: O.H.S.A. and Regulations for Construction Projects, as may be amended from time to time, outlines the requirement to file a Notice of Project with the Ministry of Labour, under certain circumstances as outlined in the Section. Forms are available from the Ministry of Labour Offices. Responsibility to file notice of Project (if required) is the sole responsibility of the contractor. All welding, cutting and related operations shall be performed in accordance with Canadian Standards Association Standard "CAN/CSA-W117.2-M87 safety in welding, cutting and allied processes, as may be amended from time to time, with specific reference to Section 9.7 fire prevention and protection. All welding, cutting and related operations require the application for and the completion of a "HOT WORK PERMIT" issued by the applicable maintenance department, PRIOR TO THE COMMENCEMENT OF THE WELDING OPERATION. Workplace Safety & Insurance Board Certificate The successful bidder will be required to submit an original Certificate of Good Standing from the Ontario Workplace Safety & Insurance Board on request by the College and shall provide additional certificates as often as is deemed necessary by the College during the term of the contract to ensure continued good standing with the Workplace Safety & Insurance Board. - OR - The successful bidder shall provide proof to the College from the Workplace Safety & Insurance Board that the successful bidder does not require Workplace Safety & Insurance Board Insurance. If the successful bidder changes its status with the Workplace Safety & Insurance Board during the term of the contract such that coverage is required, the successful bidder shall immediately provide the College with the W.S.I.B. Clearance Certificate. ENVIRONMENTAL CONSIDERATIONS Sustainability If applicable, provide any information on your company or products as related to sustainability or green initiatives, such as recycled materials, disposal, etc. Where applicable and practical please submit information such as company brochure(s), MSDS sheet(s), etc. in electronic format, i.e. memory stick or CD. The “Form of Proposal” section and the cover page must be submitted in hard copy duly completed and signed. Provide specific and verifiable information regarding environmental initiatives undertaken by the vendor and the manufacturer. All packaging and shipping materials, including interior, must be removed from every part of the product, and from the College property. The College promotes environmental friendly packaging and operates an extensive on campus recycling program, it is strongly suggested that wherever possible, the packaging and shipping materials should be recyclable and recycled. In the interest of supporting Mohawk College’s sustainability initiatives, we would like to request the following: • All proposals submitted should be on two-sided recycled paper where possible. • Proposers should refrain from using excessive and unnecessary packaging when shipping or mailing their responses. • Vendors should refrain from using superfluous binders where possible, especially for additional copies being requested. • Vendors should consider presenting peripheral information (i.e. company and product brochures) on CD or DVD where possible or practical. Environmental Consideration will be given to equipment, products and supplies that are environmentally friendly and Energy Star rated for energy efficiency. Please indicate in your proposal whether your equipment, products and supplies meet the above.
